Tenancy law effectiveness
The new reference values will take effect on 1.st April, 2019 under tenacy law. New leases can be concluded on this basis from 1.st of April. Existing rental agreements based on the old reference values, may be increased from May 2019 with corresponding value guarantee agreements.
However, the formal requirements (§ 16 Abs 9 MRG) must be taken into consideration:
In any case, the request for a raise must be made in writing and must not be sent before the entry into force of the tenacy law effectiveness (not before 1 April 2019). Attention: A letter that has been sent too soon has no legal effects (not even in the following month!).
The claim for increase must be received by the tenant at least 14 days before this Interest Payment Date, taking into account the earliest possible due date on the fifth day of May 2019. Since the 21.04. falls on a Sunday, the receipt by April 19 at the latest will be taken into consideration. If the request for increase is later received by the renter, the increase will only be due on the next following interest payment date.
